Rape functions to maintain control over women through the production of fear. To call rape violence avoids the problem of male sexuality. It is women"s sexing that makes rape a sex crime and not a crime of physical violence. Many problems associated with formulating rape to a universal model. The victimization of rape is spread unevenly throughout the female population. By formulating rape to a universal model it makes rape seen ungovernable. According to smart the law fails to understand account of rape that do not fit in the narrowly constructed legal definition of rape. One problematic feature of the rape case is that it becomes entangled with construction of sexuality in which men acting according to some uncontrollable urge. Through this men are not expected to take full responsibility to their action since it is something they can"t control. A large amount of sexual assault goes unpoliced. 1/4 of sexual assault are reported to police.
