Seek to establish equality in certain contexts: not when the state is an actor, but another entity is an actor. Everyone is free from discrimination in any type of contracting: ontario. Each province has their own human rights code: some differences from jurisdiction to jurisdiction. Legislation establishes separate remedial forum: file a complaint here, decision making body. Ontario human rights tribunal: often quicker, announces commitment to equality, don"t need a lawyer to represent you, can"t just sue for discrimination. Courts are left w/no requirement to address equality in cases: decreases remedies for victims of discrimination. Claim of discrimination can be decided by a court parasidically: ontario court has established that if you have a tort or breach of contract action they will look at that, and look at discrimination separately. Don"t see many discrimination cases before the court: costly. Decision to the tribunal can be reviewed by the judicial system: through the appeal process.
