Trials: most trials are heard before judge alone in the ontario court of justice, some more serious charges are heard in the superior court of justice, can be heard by judge or jury. In judge trial, the judge decides the facts. In jury trial, the jury decides the facts while the judge directs them to the relevant law. Offences: trial options are determined by the nature of the alleged offence, there are three types of offences. If a preliminary inquiry is held, the trial will appear in the superior court. Summary conviction offences: the most minor, often nuisance, offences, punishments are relatively light, the only trial option is a judge trial, there is no preliminary inquiry. Hybrid offences: biggest category of offences, offences for which the prosecution can choose whether to proceed by indictment or summary conviction, once they choose, the accused has the trial options for the category that is described above.
