Recap: bulk of employment law is termination, and in particular termination by employer, resignation is possible, and constructive dismissal (where employee is forced to resin---> not talking about these two) Two primary sources of law: statutes (esa) and common law. Basic statutory response to termination: notice of termination and severance: anyone in ontario who is an employee has been dismissed within sufficient notice of termination (at least 3 months) and this tends to be 8 weeks notice. If they"ve worked for 5 years they also get severance: they can bring a complaint to ministry of labor that their notice was not sufficient. It is not suing, it is strictly an administrative procedure. It doesn"t cost much, suing for wrongful dismissal----> seeking common law remedy. Statutory is not in court (statutory is just bringing a complaint) Today we"re talking about suing in common law (wrongful dismissal, breach of employment contract)
