There are numerous circumstances where confidential patient information may be disclosed without consent. Various health care, health information and other statues permit and, in some cases, require disclosure highway traffic act, health protection and promotion act. Search warrants, subpoenas and other court orders. Common law right to disclose confidential patient information without consent in seeking advice on patient care from colleagues within and outside the organization. As little identifying information as possible should be disclosed. Implicit common law right to disclose confidential patient information without consent in: compassionate situations (call wife when husband in er), and in undertaking internal audit, quality assurance measures and other management tasks (ensuring workers follow policy) Implicit common law right to disclose confidential information arises when a person applies for a benefit, exemption, placement, referral or reference, but it may be prudent to get explicit consent in these circumstances. An implicit common law right to disclose confidential information will be negated by an express refusal.
