Tort: the law of actionable wrongs between private individuals (as opposed to criminal law between individual and state) So in tort law, one person sues another for the wrong thing done. Actionable = recognized at law as something you can sue for. Damages: the usual remedy, means money judgment. Purpose of damages in tort: to place the plaintif in the same position it would have been in had the tort not occurred. Non pecuniary loss, pain and sufering, anything that is difcult to quantify precisely. Can include future pecuniary losses, since its hard to quantify something like how much lost income may result from, for example, a car accident. We can never know with certainty what their future losses are, even if at the present they are easily quantifable. Pecuniary, what is easily quantifed in dollars and cents. For example: you missed 3 days of work: that"s easily quantifable. Or you had to pay for 3 physiotherapy sessions.
