I will say yes, but this is actually a contract, even if there is no form, it is still a form of contract. We are each going to get something out of this, i will get a sealed driveway for the winter, and the man will get his money. When the man knocks on the door and says they are done, they have a right to the money, and i have a legal duty to pay them the money as well. Their right is connected to my obligation. A person commits an assault by harming another person without their consent. I have a right not to be punched in the face, and that means that everyone has a duty not to punch me in the face.
