Classical natural law theory is a strong natural law theory. Germans couldn"t use positive law because there was a law of people. 1st of all this is a mis interpretation of aquinas he isn"t aristotle attempting to derive moral or legal obligation. aquinas is not natural law ethical theorist. Doesn"t really matter that finis is wrong because then he reproduces his own interesting theory of law. Some people describe finis theory as a countian theory. We need context to tell us the end and why its there in the 1st place. Cant understand law if u dont understand the purpose. The what of the law cant be separate from the why of the law. Need to understand the functions of the purpose of why the legal system exists. It can never be that you will be able to just be a natural law theorist.
