A newer area of intellectual property law is rights of publicity law. This is when a law protects someone"s right to use their face, voice, persona, etc. to stop other people from taking photographs of them to use them without their permission for making money. Every state has their own publicity law rights. Not all us states use a state for right of publicity, but most do. The idea behind this is that if you"re well known, you should be able to use your likeness, signature, name, voice, etc. to endorse and sponsor products. The point is to allow individuals to get paid for endorsing something on their behalf. Beyond considering someone as a celebrity or being a newsworthy person, there are other exceptions to publicity law rights. You can get a signed waiver from someone detailing that you have the right to use their likeness, voice, and name.
