There are various states that have notification statues. This requires notification if there is a breach of notification. This depends on the state statute and case law per state. Reasonably likelihood that the unauthorized part has: acquired the information, this could include misuse or material risk. For example, with new mexico, an exception to this is that it has not or is not likely to cause substantial loss or injury to one of more residents.
