When it comes to businesses and social media, first amendment protections depends. When it comes to social media, consider the level of privacy and if it is something that can easily be accessed by anybody or is it protected by certain settings, is it under a fake name, etc. Also, companies can have their own social media policies. Keep in mind that the first amendment is meant to protect speech when it comes to the government, not necessarily private employers however, if you recall whistleblowers, there are other protections for workers to air grievances about workplace safety. Instant, for example it"s faster than updating a website. These can also all be considered negatives in some way. Why companies would want to restrict online expression: To protect the message they want to give/prevent any kind of misrepresentation. In a 2014 study by proskauer rose llp, they said: 80% of businesses had policies about social media in place.
