Before the 1970s, the department of the interior handled these issues. Most environmental laws are based on statutes (legislative/judicial) There are state equivalents to federal laws; can be more narrow only. Most court decisions interpreting environmental statutes will come from scotus. Scotus justices are nominated by the president and confirmed by the senate. President can enter into treaties related to environmental law (montreal protocol, kyoto treaty, etc. ) Often do so due to campaign promises, congressional gridlock, or emergencies. President can also issue signing statements a way of commenting on or changing laws passed by congress rather than voting them; use of power condemned by aba. Council on environmental quality (ceq) works with the nepa and advises the president on environmental issues. Congress delegated its authority to them to carry out administrative duties that they don"t have the time or expertise to carry out (epa) most members are former attorneys, not former environmental specialists.
