Creation of the national pollution discharge elimination system (npdes) Creation of section 404 wetlands permitting system. Majority argued that isolated intrastate wetlands cannot be considered navigable waters of the us. Some estimates put 75% oof all wetlands in us in this category. Means that states can still do what they want. A water or wetland constitutes navigable waters" if it possess a significant nexus" to waters that are navigable or could reasonably be made so. If the wetlands, alone or in combination with similarly situated lands in the region, significantly affect the chemical, physical, and biological integrity of other covered waters understood as navigable in the traditional sense. Information asymmetry i know something you dont know. Much, if not an overwhelmingly majority of, federal policy- especially environmental policy- is divided by unelected bureaucrats in one of the many executive agencies.
