Injured persons can sue for actual (compensatory) damages, and possible punitive damages (where applicable) Intentional torts: assault any intentional attempt or offer to cause harmful or offensive contact with another is an assault, if it causes a well- grounded (reasonable) fear or apprehension of imminent harmful or offensive contact. Whether contact actually occurs between the plaintiff and the defendant is irrelevant (no contact is necessary for there to be an assault an assault occurs when the plaintiff reasonably fears or apprehends harmful or offensive imminent contact) Fear and apprehension are also not the same thing (1 works) The plaintiff must also be aware of the threat (if you stand over someone"s bed and wave a knife over them while they are asleep, legally no assault has occurred)
