Definition: written, you cannot codify without having a written text, enacted by a state or on the basis of state authority must be behind the law. This is what we are going to apply : systematical, the aim is to make the citizens know their rights. So there needs to be some system: exhaustive, the whole area that is said to be regulated, needs to be regulated (example criminal law), exclusive, there is nothing outside the area that is codified. Start codification period: 2nd half of the 18th century. Jeremy bentham (1748-1832) was the one who started the discussion on codification. Believed in the theory of the greatest happiness for all. Society should be organized in such a way that people would live a worthwhile life . Codification was influenced by teachings of natural law / vernunftrecht , and the law of reason.
