Document Summary

Madison outlined the roles for congress in the constitution. He gave congress and the federal government supreme power over state governments. Within the federal system, congress and the legislature became the most important systems. Congress is limited by the power enumerated in the constitution. However, they also have implied and expressed powers. Their enumerated powers include: borrowing money, levying taxes, regulating trade, immigration policy, money regulation, jurisdiction of capital cities, intellectual property protection, declaring war, raising support for the military and setting the code of conduct for the military. Congress implied powers are punishing tax evaders, setting standards for states to receive funding and regulate drugs/alcohol. The articles of confederation were created after the revolutionary war and ratified in 1781. Congressional authority was limited to the powers expressly given. At the time, the government could not levy taxes, they relied on donations from states. They were limited in terms of waging war and had no foreign policy plans in place.
