Tort: a wrongful act that causes harm to an individual. Punitive damages: punishment of the company for its failure to respond properly to the misconduct. Exaggeration or fabrication to improve chances of receiving some award if there is a claim for psychological disturbance. Physical and psycholgical injuries suffered at work. The cost of whatever treatment is given. Capacity to understand information that is relevant to decision making in a given situation and then make an informed choice about what to do in that situation. Involves indicating what type of tx they would like. In case they are later incapacitated or incompetent to make tx decisions. Executed will less than 1 year before death. To give opinion about state of mind after a person has already passed. Wishes of the child, wishes of the parents, relationships between child, parents, siblings, sig others, childs adjustment at home/school in community and physical and mental health of the parties involved.
