This high incarceration rate should encourage us to act. Traditionally a juvenile is considered anyone under the age of eighteen. Often, juvenile alleged offenders will be tried in the juvenile court system, which is a network of agencies that deal with children whose actions have conflicted with the law. Every state has their own laws regarding youth being tried as adults. In south dakota, circumstances for adolescents to be charged as adults include habitual offenders and homicide cases. Juveniles who commit heinous crimes are not fully capable of comprehending the consequences of their actions; therefore, instead of going to state prisons these offenders should be rehabilitated in detention facilities. Children who commit crimes are considered complicated as far as the legal world is concerned. Children have less of an understanding of the laws, and deserve special protection.
