Review of key terms and concepts thus far: Adversarial justice: based on common law, two sides (prosecution and defense) advancing their viewpoint based on evidence, state is responsible for proving beyond a reasonable doubt that the defendant is guilty. Note that the inquisitional system is the opposite. Change of venue: the judge may change the location to ensure a fair trial (unbiased jury), usually the defense would request a change. Requesting a change of venue does not ensure that the venue will be changed- the judge has to approve the request. Venue: location of the crime determines what court that accepts the case. Checks and balances: prevents any one branch of government from becoming too powerful. Each branch of government has checks of the other two branches. Comity: curtsey of respecting and accepting documents from one state to another (licenses). Court of last resort: the supreme court. (supreme court of states and the us supreme court).
