Document Summary

Bail: 8th amendment, bond is what you post to get bail. Release on recognizance- accused released from custody (cash deposit on their word, etc. ) Discovery: evidence from prosecution must be shared with the defense. Motions in criminal cases: defense suppresses introductions of evidence by the prosecution. The defense is trying to make sure that all evidence was properly gathered and trying to exclude any improperly gathered evidence. Dismissal of charges: law enforcement will charge suspects with anything possible, but the prosecution narrows down which charges will stick/ be able to be prosecuted. Limits the scope of what the prosecution has to prove. Change of venue: in attempt to ensure an unbiased jury. Continuance: one or both sides need more time to prepare their cases. Note the issues with the guarantee for the quick and speedy trial. Charges not resolved through please or deal go to trial. Jury vs bench trial (judge in role of tryer of fact and law).
