Innovative thinking v. stare decisis do we decide based on case law and previous decisions, or do we take each case as its own unique situation and decision. Psychology is empirical/law is authoritarian: empirical psychology uses empirical data, there are ways around things, can be interpreted, authoritarian these are the rules, this is how they are applied, there are no shortcuts. Psychology is descriptive/law is proscriptive: descriptive describes the world around us and explains why we interact and do the things we do, proscriptive describes what we should and should not do. Psychology uses replication/law uses case law: replication replication in studies is used to validate the findings, case law use past cases to decide the one you are handling now, stare decisis. Forensic psychology area of psychology that overlaps with law: forensic psychologist used to always be a clinical psychologist, but now its anyone who works with the law.
