The essential role of the judiciary in the american governmental system is to interpret the. 2-1 judiciary"s role in american government laws and apply them to specific situations. Judicial review: judiciary branch decides whether the laws/actions of the other two branches are constitutional. Makes sure the other two branches are in line with the system of checks and balances established by the constitution. Established by the us supreme court in 1803 after the marbury vs madison case. Case stated that it"s the judicial department to decide on the laws and if two laws conflict, the courts decide operation of each. Jurisdiction, venue, and standing to sue are required before a lawsuit is brought to court. Court must have jurisdiction over the person/company against whom the suit is brought and over the subject matter of the dispute before hearing the case. In personam jurisdiction (personal jurisdiction): court has jurisdiction over any person/business residing in that geographic area.
