Involves relaxed state, more receptive to suggestion. Involves procedure to relax witness, provide multiple opportunities to report, and avoid coercive or leading questions. Is difficult for police to adopt this method. Competence- whether an individual has sufficient present ability to meaningfully participate in and perform necessary personal/legal functions. Competency to stand trial- ability to participate in criminal proceedings and to aid in one"s own defense. Competency to stand trial only refers to the time of the trial, not the time of the crime! Does not mean people with any sort of psychosis can not be held competent; they just need to have the minimal understanding of the process. Flexible standard- believe that people with serious charges should be more competent than those with less serious charges. Presumption of competency to stand trial- defendants are presumed to be competent unless proven incompetent. Beyond a reasonable doubt- governs decisions about guilt in a criminal case.
