These measures must not be an undue burden on the right (vaughn, 436). The state also reserves the right to enact health and safety regulations in protection of a woman seeking an abortion. The court believes that before the fetus is viable, the woman has a right to choose to terminate her pregnancy. After the fetus is viable, the state can intervene and the state protection overrides the rights of the woman.
