Statutes- a law enacted by state legislature or congress. Congress (federal laws)- dictated by the federal constitution. State legislatures- all laws not stated in the constitution can be regulated by the states. The irs is a federal administrative agency. Bob jones university v. irs- most charitable organizations are tax exempt (most universities are), irs says if you discriminate you won"t be tax exempt as bob jones u was not letting certain people enter their school. Common law: judicial decisions make law. State/federal: two systems, preemption- idea that if federal law and state law both exist in the same area, federal law rules, supremacy clause- federal is the supreme law. Criminal- state v an individual or fed vs individual: remedies. Criminal is jail time, probation or fine. Civil is generally just monetary damages: standard of proof. Civil- a person is held liable (legally responsible)
