The reason we should obey the law is because we have consented. One kind of consent theory says that it is enough that we would have consented if the choice would have been given to us. The other kind of consent theory (the one we"re engaging with) says that although i did not say that i consented in any kind of explicit words, we"ve done something that is tantamount to an agreement. The restaurant example from last class is an example of tacit consent. It is voluntary that we enter into an agreement. The place to start is with the voluntariness condition. Beran says that what makes us obligated to follow the law is accepting full membership of the state. Accepting full membership of the state is equivalent to voluntariness. By being within the state, you"re accepting the various benefits of the state and that is enough to constitute full membership within the state.
