Rawls has an assertion of desert in a way, but it"s no use in answering the question of what our institution should look like. We don"t worry if the worst off have a chance to do better. We accept the inequalities as long as if the worst off are better off than they would have been otherwise. Rawl"s regards aristocracy as the difference principle + formal equalities of opportunities. If we"re going to help the worst off by making them as benefitted as possible, then we might as well add to this and give them genuine equal access to the good positions.
