Cruel and unusual punishment: a sentence or conditions of confinement that go beyond what is acceptable in society. 2001 supreme court ruled it would violate 8th amendment to execute an offender w/ mental retardation or under 18 years old. Death penalty unconstitutional in regards to rape. 2010 supreme court: sentencing a juvenile to life w/out parole for a crime that is not murder. Presentencing investigation report: a report that provides the court w/ a basis for making a sentencing decision by including a personal history of the offender, victim impact statement & a recommendation for sentencing. Incapacitation: aims to make it impossible for the offender to commit a future crime. Rehabilitation: aiding offender to learn skills to help prevent the person from reoffending. Indeterminate sentencing: offender given a range of 5-7 years. Determinate sentencing: a precise period of time offender must serve. Consecutive sentences: sentences served in sequence instead of the same time.
