Document Summary
Lochner v. new york, 198 u. s. 45 (1905) In lochner v. new york, joseph lochner, the owner of the lochner home bakery let their employees work for more than ten hours a day; which violated the new york bakeshop act of. 1895 that limited the hours a baker could work. In this case, the proponent argued that this can cause a health violation because of the exposure to flour dust for several hours. York bakeshop act of 1895 should be imposed and lochner should be fined. The opponent argued that the act and fining lochner violates the fourteenth amendment that guarantees liberty of work . Lochner takes the case to the supreme court where he wins by 5-4 votes. Peckham mentions, the general right to make a contract in relations to his business is part of the liberty of the individual protected by the fourteenth amendment of the federal constitution (gillman, 429).
