When it comes to creating laws and regulations the one thing that you want to avoid is ambiguity. That is to say there should not be interpretations of the law, it should be set and finalized. That is why basing a legal system of islam has run into many problems. In the time of muhammad it seems that women had freedoms and rights denied to them under current islamic regimes. Muhammad himself married into a rich family via a widow. This widow, muhammad new wife, who owned her own trading company and was very prosperous. However under current interpretation of sharia law, women are very oppressed and have little rights. The ambiguity of sharia is the problem here. The same could be said about jihad, or the struggle. Is it a personal struggle to become a better muslim or is it a struggle against forces that seek to destroy islam.
