The 1895 cases and the 1896 election: congressional power during the gilded age. 1887 = interstate commerce act: regulates private corporations (first regular law by congress) Also created the icc (interstate commerce commission) Regulates prices charged by railroads to ensure regulation of a monopoly. Regulation of monopoly in restraint of trade. 1894 = federal income tax, progressive and small scale. 1916 = child labor act: prohibited wage work for those under 14; All the above were challenged in supreme court; laws exceed the scope of congress" power. Period is called the gilded age (1890-1936): economic inequality. Major conflicts are about regulating the economy, but also regulate the increase of lynching (bills to be proposed for a ban, but get vetoed on unconstitutional) - 1921-1922. The police powers: states retained; power of government to protect public health, public safety, and public morals (vices)
