In md v pringle (2003) us s ct held that if police find contraband hidden in vehicle, can arrest everyone in it. When cops exceed their authority in conducting search and viol 4th released, cops may be sued. Cops must rely on training they recv and updates from attys to know their limits. S ct defines search as action by law enforcement that intrudes on areas expec of privacy. A seizure happens when officer stops someone, and he is not free to leave. When cop holds a suspect in handcuffs officer 3 hours while searching his home, is seizure. A brief seizure is called a stop, brief interference with freedom of movement duration: minutes. Must have articulable suspicion that crime activity afoot. Stops can be made without such suspicion in special situations, such as border stops. Distinguish arrest: significant deprivation of liberty= custody, transport to jail, processing so require higher level of suspicion: pc.
