Philosophies restorative justice: imbalance occurs when a crime committed justice must be restored or rebalance. Can happen via dialgiue and negotiation b/t victims, law breaking, or community stakeholder. Emphasis on the victim"s need reintegration: ultimate goal is to connect the person to legitimate areas of society in a productive manner that reduces recidivism (family, jobs, marriage) Sanctions must be proportionate w/the type of criminal behavior committed. Prison beds need to be saved for those who pose the most serious ridsk. Alternative sentencing is important for treatment purposes, not just punishment. Probation & intermediate sanction (community services, ankle monitoring); all community based sanctions. Incarceration (jails, state & federal prisons, supermax facilities) Supermax facilities hold the offenders who pose the most serious risk and have no deterrent value. Presentence investigation report (background, education, demographics); prior criminal history taken into account length of incarceration. Mandatory minimum sentences: guidelines that limit judges discretion in sentencing. Ex) enhanced sentencing- repeat offenders, gang membership, weapon possession.
