POLS 1301 Lecture Notes - Lecture 1: Implied Powers, Commerce Clause, Concurrent Powers
Document Summary
Powers of national government: exclusive powers, concurrent powers, powers reserved to the states. Mcculloch v maryland case: mcculloch worked in a bank owned by the national government, and the state of maryland wanted him to pay taxes, but he refused to. Mcculloch then decides to take the case to supreme court. It was argued that the federal government had the right to own the bank without. Mccullock having to pay taxes, because the federal government has the power (implied power). Gibbens v ogden case: this case is about the ferry boat owners gibbens and ogden. Ogden had license from new york but gibbens had license from the federal government, so ultimately gibbens wins the case to being able to use the water. Wickard v filburn case: a farmer named filburn was using one part of his land to feed his animals, one to sell crops into the market, the other to consume by himself.
