CRIME CONTROL VS. DUE PROCESS
Crime Control Model
➢ Assembly Line Justice
➢ Speed and Efficiency are the main goals
➢ Effort is to repress crime
o Promotes plea bargaining
▪ The defendant will plead guilty to the original charge in return for a
reduced sentence
▪ Necessary evil
▪ Reduces society’s interest in appropriate punishments for crimes
Due Process Model (5% or less)
➢ “Obstacle Course Justice”
➢ Adversarial (Courtroom) Process
➢ Strained Resource are problematic
CASES
Boykin v. Alabama (1969)
- Defendants must state that they made their pleas voluntarily, before a judge can accept
the plea
Santobello v. New York (1971)
- If the prosecution has promised a lenient sentence as a result of a plea deal, the
prosecution must keep that promise
Death Penalty as a Criminal Sanction
➢ The U.S. Suspended its use from 1972 to 1976 amid debates concerning the Eighth
amendment (cruel and unusual punishment)
Furman v. Georgia (1972) – Suspended death penalty, but also helped states rewrite their death
penalty laws to pass Constitutional threshold
- The manner in which some laws were written is inconsistent, and that is unconstitutional,
not the death penalty itself
CORRECTIONS
All programs, services, facilities, and organizations responsible for the management of the
accused and convicted.
Jail and correction facilities (30%)
Community corrections (70%)
- parole and probation, work release, community service
Penitentiary (prison) – An institution intended to punish criminals by isolating them from society
so they can reflect on their crimes and reform
Recidivism – the turn overrate of how many inmates would become repeat offenders
