Involuntary confinement of individuals judged to be a danger to themselves or other, even though they have not committed a crime: potential suicide, threated violence, destruction of property, or less impulse control. Involuntary commitment will protect the individual for his/her own good. Involuntary commitment will guarantee that an individual receives the treatment. Involuntary commitment prevents harm to other people in the community. Involuntary commitment unmanageable state of fright or panic. Procedures in civil commitment: prevent harm to the person onto others, provide appropriate treatment and care, ensure due process of law, voluntary commitment hospitalization/ positive treatment outcome, formal civil commitment. Rights of mental patients: balance of power b/w the state, mental institutions, citizens, commitment for any purpose constitutes major deprivation of liberty require due to process protection. Least restrictive environment all patient has a set of legal right: right to treatment and the right to refuse treatment (dixon v. weinberger)
