Civil liberties- protections in constitution from gov"t power. Civil rights- protections by gov"t power; obligation imposed on gov"t to take positive action on behalf of its citizens. Missouri compromise of 1820, wilmot proviso (1846) and compromise of 1850. Wilmot was making an attempt to stop the spread of slavery westward. Even though proposal was voted down it contributed to north-south tensions (sectionalism) Occupation of south by north known as reconstruction During reconstruction, life was relatively good for african-americans # of political parties pursuing their votes + black welfare indices improved. The democrats tended towards racial conservation + violence during this period. By 1877 all former confederate states reverted to white democratic control. Commitment from northern republicans waned, passed laws, no enforcement. Grandfather clauses to protect poor and illiterate whites. Rooting out racial discrimination in the distribution of relief aid. Smith vs allwright - eliminated white primary laws. Brown vs board of education of topeka - trumps the plessy decision.
