Document Summary

Modification is an amendment to a pre-existing contract. Some jurisdictions require fresh consideration to demonstrate the intent of the parties. Some only require that the modification be fair and equitable. Multiple fisherman agreed to work for defendant at a pay of 50 or 60 dollars for the season with an additional 2 cents for each salmon caught by them. Once the fisherman arrived in alaska, where their contract for work was to be performed, they demanded an increase in pay or they would not work. Defendant was unable to find new workers and thus agreed to their demands. However, defendant"s superintendent, who agreed to the fishermen"s promises, informed the fishermen that he had no authority to enter into the contracts or alter the original contracts made by the fishermen. Upon return from alaska, the fishermen attempted to collect on the increased contracts. Defendant would not award the increased pay.
