Foucault says the prison, as an institution, is a structure of the past. Not the case in the us -- the prison has not at all disappeared. Foucault theorized new forms of control would take place. New forms of control have taken place, but prison control is still evident. Processes of surveillance take place not only in jails and courtrooms, but also in schools, social welfare agencies, psychiatric offices, etc. to categorize people and use those categories to control them. Waucant argues: the state operates on the belief that it has a right to dominate people. When the state is failing to provide for people, it risks losing its legitimacy. So the left hand of the state provides for its people, and then the right side (carceral, punitive side) uses fear to assert its power. Neoliberalism has been a shift from the left hand of the state to the right hand of the state.
