Dred scott racial category of citizen; not whether you are national origin other than european; those racial distinctions that we assume, especially today; that is not the fundamental racial limit to the category of racial citizenship. The category of the citizen is constructed against category of non- human. Category of citizenship delimited by various kinds of understandings of difference. Two various logics at work here between dred scott and koramatsu. Distinction between civil rights, social rights, and political rights. Our constitution does not use this language of civil, social and political rights. In some cases, it does not even mention certain rights such as liberty.
