Right to Privacy?
-4th amendment protection of private homes from searches and seizures
without a warrant
-9th amendment: “ The enumeration in the Constitution of certain rights
shall not be construed to deny or disparage others retained by the
people.”
-14th guaranteed due process in the states.
-In
Griswold v. Connecticut
(1965), the SC asserted that the Bill of Rights
created a “zone of privacy” that gave individuals the right to make
choices regarding sexual reproduction.
-In
Roe v. Wade
(1973), the SC ruled that a woman’s right to seek an
abortion during the first three months of her pregnancy rests on the
right to privacy.
-In
Lawrence v. Texas
(2003), the SC struck down anti-sodomy laws in
every US state and territory.
Freedom of Religion
The 1st amendment prevents government from interfering with freedom
of religion in two ways:
-Establishment clause prohibits laws establishing religion
-Free exercise clause prohibits the government from interfering
with the exercise of religion
Establishment Clause
-The Supreme Court has consistently maintained that religion cannot
benefit directly
-Early cases allowed public $ to pay for parochial school busing and
textbooks.
