Facts are found in many places (client, witnesses, documents) But for us: gauchospace the codes come second. Need to find a law to put your facts and client"s problem into context. Codes are made up of elements that must be met in order for the code to apply. 2. intentionally or recklessly acts: actions cause emotional distress. 4. the emotional distress was severe the issues come third. Compare facts to law to generate legal issues. Legal issues are specific questions raised by the facts. Questions the parties bring to court for resolution. Problem with proving or disproving 1 or several elements/ prongs of a cause of action. Must be absolutely essential, cannot be ignored. If changed or removed, the situation/outcome is changed. Establishes or satisfies the elements for the code/causes of action. Can be individual or groups of facts.
