The power and role of the federal judiciary -- and the supreme. Court in particular -- in the constitutional system. Federal courts have any jurisdiction over any case wherein the two parties are from different states (diversity jurisdiction) The supreme court now has a certiorari jurisdiction- people have to convince the court to take the case. The federal courts do not exist to answer state law questions unless diversity jurisdiction is involved. 99% of the cases the court takes are discretionary. Has to be relevant to the whole country. Discussed: conflict about different courts, the importance of the issue, *other side has the opportunity to respond to the certiorari* Friends of the court can respond to support or appeal the certiorari. Cert. pool : 8 justices come together and write a memorandum, reviewing. If four judges out of 9 vote to go forward with the case, the review will be granted. If fewer than 4, then it will not be granted.
