In loco parentis: in place of the parent ; once kid steps into school develops guardianship: once kid at school, school obtains role of parents. Looked at in 2 ways: right side: it has decreased over the years due to the movement of students rights, school has to lay off punishing a student. There was no notion of students rights until the tinker case, which develops idea of students rights. Freedom of speech is guaranteed by us constitution; but it"s limited, within certain bounds gov"t can exercise restraint of speech. Restrictions required in order to protect state from destruction or from serious political, economic, or moral injury. Courts assume school rules and regulations on speech are okay unless there is a clear abuse from school. A rule may be challenged if : 1).
