Discussion in which we debated two sides of the blackstone ratio reflects these conflicting goals in deciding what law we will support or create. Basic choices: conflicting goals: conflicting goals: the rights of the individual vs. the rights of society as a whole, crime control vs. due process. Is it better that ten guilty persons shall go free than one innocent person should suffer. And i told you when i gave it to you that there were good arguments to be made on both sides. We both want our cjs to free innocent people and to put the guilty people in prison. When we talk about the benefits of one side we cant have both, it leads to this internal conflict. It is better to sacrifice the innocent person and have the ten guilty go to jail because it ensures we wont have ten new victims and get out and commit recidivism.
