Primary duty is to resolve questions of fact (which is decided by jury). Judges role is to help jury to make sure that legal duties are followed (questions of law) Bench trial: the judge presides over entire trial with not jury. Judge answers both questions, usually both sides have to agree. If either side loses, they have choice to appeal. Manifest error: if whatever the trial court decided is 100%, certainly wrong, questions of law can be in brought up in appellate court: selection / appointment of judges. Federal judges are appointed by president, and confirmed by congress. State judges are elected, appointed by government or commissions of attorneys. Pros to being elected: terms, so they can be elected out. Cons: subject to public opinions: jurors, petit jury.
