Burden of standard of proof criminal case: the prosecutor has to show beyond a reasonable doubt that you are guilty of what you"re charged with. If there"s any doubt, a jury can"t find you guilty. Prosecutors are going to create charges, because they may not be able to prove beyond a reasonable doubt, but it gives them the chance to bargain with you. There is a high standard because of the penalties in criminal cases. Burden of proof in a civil case: perpondence of evidence (more likely than not) Both sides are working to bring in a fact record that they are going to bring into court. Criminal cases provide legal representation if you can"t afford one. Civil cases don"t provide legal representation if you can"t afford one. If you can"t afford an attorney, you won"t make bail. Legal aid is underfunded; there are no standards for the provided legal services.
