LEGAL 250 Lecture 15: 1/2 of Semester Notes
Document Summary
Law is domain of professionals (i. e. lawyers and judges) the rest of us don"t belong. Legal studies: law and society not separate, law shaped by, and shaper of, social reality. Legal studies challenges the notion that obedience to the law is liberty or justice (i. e. that law guarantees the best possible chance for relative liberty by constraining our nasty, brutish selves) Legal studies founded by lawyers goal was to poke holes in the legal system for the sake of profess o progressive nihilistic juxtaposition. Traditionally, law is produced by legislators, judges, administrators and executives, and constitutional conventions: about the law, not the humans who make it, apply it or are subject to it law doesn"t change for people. Rule of man more subject to change (i. e. who they are evaluating changes circumstances) Specific social actors like police and district attorneys are practitioners of law, taking their cues / direction from those traditional sources.
