Legend says it was done on midnight on the last day adams was president, Jefferson took of ce when the commissions were supposed to be delivered. Marbury"s commission was supposed to be delivered by marshall, but he didn"t get there in time before jefferson came back into of ce. The delivery was delayed due to crowds of jeffersonians to see him take of ce.
