A guy comes to rob a store wearing a bandana. The clerk only gets a slight view of his face when he pulls down the bandana. The clerk did get a good view of the van. The police finds a similar looking vehicle, brings clerk to the scene. Clerk id"s the car when pulling up, says the driver is the guy that robbed the store. Two part test to determine if this testimony should be allowed in this case. The answer of the first question is relatively pointless given the second question. In this case, the answer to the first question is yes. Looking into the manson factors, the testimony was considered reliable. View: opportunity of the witness to observe the suspect. Attention: degree of attention, what is the extent of distractions. Accuracy: mental and physical acuity of the witness. Time: period between the event and the identification.
